Terms and conditions - "Laugh Outlandish" Promotion

  1. This competition (Promotion) is conducted by Melbourne Internatonal Comedy Festival Limited ABN 43 006 697 918 of 240 Exhibition Street, Melbourne VIC 3000 (Promoter).
     
  2. Entry to the Promotion constitutes acceptance of these Terms and Conditions.
     
  3. All entry instructions and prize information published by the Promoter form part of these Terms and Conditions.
     
  4. The Promotion is open to all Victorian residents aged 18 years or over.  The Promoter reserves the right to request any entrant to provide documentary evidence confirming his/her age and to disqualify any entrant who is unable or unwilling to provide such proof of age upon request.  Employees and their immediate families of the Promoter and their agents are not eligible to enter the Promotion.
     
  5. The Promotion commences at 12:00pm AEDT on 25 March 2022, and ends at 11:59pm AET on 10 April 2022 (Promotion Period).
     
  6. The Promotion is a game of skill and chance plays no part in the determination of the winner.
     
  7. To enter, an entrant must, during the Promotion Period, visit the Promoter's website at https://www.comedyfestival.com.au/laugh-outlandish and:
     (a) enter your personal details including name, email and mobile number
     (b) provide your answer to the following question: "Tell us in 25 words or less who you think is 10/10 and deserves a very special night of laughs " (Competition Question) in 25 words or less;
     (c) submit your entry.
     
  8. Any entry which:
     (a) is received outside the Promotion Period or which fails to meet the requirements of clause 7;
     (b) does not fully comply with these Terms and Conditions; and/or
     (c) is incomplete or otherwise unlawful,
    is not a valid entry and will not be eligible to win the Prize.
     
  9. The Promoter will review the response provided by each Entrant to the Competition Question to ensure the response is comprehensible and does not violate these Terms and Conditions. Any response that is incomprehensible, obscene, defamatory, threatening, or unlawful may be disqualified, at the sole discretion of the Promoter.
     
  10. There will be thirty-five winners (Prize Winners). The winners will be selected based on the entry that is judged to be the most original, creative and engaging response to the Competition Question (Judging Criteria).
     
  11. Each entrant may only enter the Promotion once. Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process in any way, including by submitting multiple entries.
     
  12. The Promoter’s decision in relation to any aspect of the Promotion is final and will be binding on every person who enters the Promotion. No correspondence will be entered into in relation to any aspect of the Promotion.
     
  13. The judging will take place by the Promoter on Monday 11 April 2022 at 11am AET at Melbourne International Comedy Festival, 240 Ehxibition Steet, Melbourne Victoria 3000. The Promoter will select the Prize Winners from among all entries received during the Promotion Period based on the Judging Criteria and may also select an additional 10 entries (Reserve Entries) that are the next best entries based on the Judging Criteria and record them in the order selected in case the original Prize Winners are ineligible or do not claim the Prize (defined below) within 3 working days of being notified by the Promoter, in which case their Prize will be forfeited and the next best entry will be selected from the list of Reserve Entries as the new Prize Winners.
     
  14. The Prize Winners will be notified by the Promoter by email within 48hours of the judging using the contact details supplied at the time of entry in the Promotion. Promoter reserves the right to verify the eligibility of each Prize Winner and disqualify any Prize Winner that does not comply with these Terms and Conditions.
     
  15. The Prize Winners’ names will be listed on the Melbourne International Comedy Festival website for 28 days following the Prize Winners being notified and accepting the prize.
     
  16. Tiebreaker: In the event of a tie, the Promoter will select the entry with the highest score for originality and then creativity and finally, if required, based on popular appeal.
     
  17. The Prize Winners will each receive:
    Four (4) tickets for the Prize Winner to attend Laugh Outlandish a Mitsubishi Motors and Melbourne International Comedy Festival event at The Famous Spiegeltent at Arts Centre Melbourne on Monday 18 April 2022, 5pm (Prize)
    The total prize pool value for the Promotion is approximately $14,000.
     
  18. The Prize will be provided to the Prize Winners by email or such other method notified to the Prize Winner. 
     
  19. The Prize is subject to change depending on availability, black out periods, as well as Government regulation relating to COVID-19. Promoter reserves the right to suspend, cancel or modify the Promotion for any such reason.
     
  20. The Prize may be subject to an event venue and/or ticket conditions of entry, including any applicable age or restriction. The Promoter hereby expressly reserve the right to eject any Prize Winner (and/or his/her guest) for any inappropriate behaviour, including but not limited to intoxication, whilst taking any element of the Prize.
     
  21. Prize must be taken on Monday 18 April 2022. Prizes are not transferable or exchangeable.  
     
  22. The Prize Winners consent to the Promoter using and/or publishing the Prize Winners’ names and/or images, and/or quoting the Prize Winners’ entries or any other statements, including for promotional purposes, in any form of media (including on social media).
     
  23. Subject to any applicable law or regulation, if for any reason beyond the control of the Promoter this Promotion is not capable of running as planned, including for any reason which affects the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any direction given by a relevant regulatory authority), to cancel, terminate, modify or suspend the Promotion.
     
  24. The personal information you provide in connection with the Promotion will be collected, stored and used in accordance with these Terms and Conditions and the Promoter’s Privacy Policy, located at https://www.comedyfestival.com.au/legal#Privacy%20Policy.  By entering the Promotion all entrants agree to the use and disclosure of their personal information to third parties as specified in these Terms and Conditions and the Promoter’s Privacy Policy.  Where an entrant provides the personal information of any third party in connection with the Promotion, the entrant warrants that the Promoter’s use of that personal information will not breach the Privacy Act or any other law.
     
  25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any guarantee or implied condition or warranty the exclusion of which from these Terms and Conditions would contravene any statute or cause any part of these Terms and Conditions to be void (Non-Excludable Guarantees).  The Promoter excludes from these Terms and Conditions all guarantees, conditions, warranties and terms implied by statute, general law or custom.  Except for liability in relation to a Non-Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction; (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter); (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax implications; and/or (f) a Prize or use of a Prize by a Prize Winner.
     
  26. These Terms and Conditions constitute the entire agreement between the Promoter.  If any part of these Terms and Conditions are held to be invalid or unenforceable by a court of law, it will be severed and will not affect the remainder, which will continue in full force and effect. These Terms and Conditions are governed by the laws of Victoria and entrants submit to the exclusive jurisdiction of the courts of Victoria and its courts of appeal.
     
  27. The prize will be provided to the prize winner by the Promoter and prize supplier. The prize winner is to liaise directly with:
