LOL TO WIN – DRINKING. DRIVING. THEY’RE BETTER APART. COMPETITION

  1. This competition (Promotion) is conducted by Melbourne International Comedy Festival Limited ABN 43 006 697 918 of 240 Exhibition Street, Melbourne VIC 3000 (Promoter).
     
  2. Entry to the Promotion constitutes acceptance of these Terms and Conditions.
     
  3. All entry instructions and prize information published by the Promoter form part of these Terms and Conditions.
     
  4. The Promotion is only open to persons who at the time of entering the Promotion:

    (a) are residents of Victoria;
    (b) are aged 18 years or over; and
    (c) have not had: their motor vehicle licence previously suspended or cancelled in the two years prior to date of entry or have more than five demerit points in the last five years.

    The Promoter reserves the right to request any entrant to provide documentary evidence confirming their age and to disqualify any entrant who is unable or unwilling to provide such proof of age upon request. Employees and their immediate families of the Promoter and their agents are not eligible to enter the Promotion.
     
  5. The ‘LOL to Win – Drinking. Driving. They’re Better Apart.’ competition is a game of skill.
     
  6. The Promotion commences at 5pm AET on 29 April 2022, and ends at 11:59pm AET on 18 July 2022 (Promotion Period).
     
  7. All entries are to be submitted via a completed online/electronic form, during the Promotion Period, found at the Promoter's website https://www.comedyfestival.com.au/2022/tac/roadshow. Incomplete or incomprehensible entries will be considered ineligible and will be discarded.
     
  8. Entrants must read and agree to the terms and conditions stipulated on the website, follow the specific entry instructions on screen and leave their name, email address, telephone number and entry response as required.
     
  9. The Promoter accepts no responsibility for late, lost or misdirected entries, entries not received for any reason during the Promotion Period or for any periods of unavailability or technical difficulties with the on-line entry mechanism.
     
  10. In the event that the winner does not take the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu.
     
  11. Draws (one prize winner) will take place at 240 Exhibition Street Melbourne at 17:00 AEST on Thursday 22 July 2022. Entries will be judged on the following criteria:

    (a) Correct response to the question: ‘Why does soon-to-be-international-sensation Chris Ryan thank her past self?’
     
  12. The Promoter’s decision in relation to any aspect of the Promotion is final and will be binding on every person who enters the Promotion. No correspondence will be entered into in relation to any aspect of the Promotion.
     
  13. The Prize Winner will be notified by the Promoter by email within 48 hours using the contact details supplied at the time of entry in the Promotion. Promoter reserves the right to verify the eligibility of each Prize Winner and disqualify any Prize Winner that does not comply with these Terms and Conditions.
     
  14. As a condition of entry, you must consent to the Promoter seeking from VicRoads, and VicRoads providing to the Promoter, details of your driving history for the purpose of confirming whether you are an Eligible Entrant.
     
  15. Eligible Entrants must be over 18 years of age to be able to claim their prize. The Promoter may require entrants to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
     
  16. If for any reason this promotion is not capable of running as planned, the Promoter reserves the right in its sole discretion to take any action that may be available and to cancel, terminate, modify or suspend the competition, subject to any requirements of law. The Promoter reserves the right to disqualify any individual who tampers with the entry process, including if an automated entry mechanism is used.
     
  17. The Promoter and the prize supplier will not be liable for any direct or indirect loss or damage which is suffered or for any personal injury suffered or sustained arising directly or indirectly from this Promotion or in connection with any prize/s except for any liability which cannot be excluded by law.
     
  18. The Prize Winner will receive:

      - A $500 Melbourne International Comedy Festival Gift Voucher;
      - Two nights accommodation at The Westin Melbourne, in a standard twin or double room, during the 2023 Melbourne International Comedy Festival (29 March – 23 April 2023);
    The total prize pool value for the Promotion is approximately $1,750.
     
  19. Redemption of the Prize is subject to any conditions specified by the Melbourne International Comedy Festival.
     
  20. Subject to any applicable law or regulation, if for any reason beyond the control of the Promoter this Promotion is not capable of running as planned, including for any reason which affects the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any direction given by a relevant regulatory authority), to cancel, terminate, modify or suspend the Promotion.
     
  21. The personal information you provide in connection with the Promotion will be collected, stored and used in accordance with these Terms and Conditions and the Promoter’s Privacy Policy, located at https://www.comedyfestival.com.au/legal#Privacy%20Policy. By entering the Promotion all entrants agree to the use and disclosure of their personal information to third parties as specified in these Terms and Conditions and the Promoter’s Privacy Policy. Where an entrant provides the personal information of any third party in connection with the Promotion, the entrant warrants that the Promoter’s use of that personal information will not breach the Privacy Act or any other law.
     
  22. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any guarantee or implied condition or warranty the exclusion of which from these Terms and Conditions would contravene any statute or cause any part of these Terms and Conditions to be void (Non-Excludable Guarantees). The Promoter excludes from these Terms and Conditions all guarantees, conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non-Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction; (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter); (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax implications; and/or (f) a Prize or use of a Prize by a Prize Winner.
     
  23. These Terms and Conditions constitute the entire agreement between the Promoter. If any part of these Terms and Conditions are held to be invalid or unenforceable by a court of law, it will be severed and will not affect the remainder, which will continue in full force and effect. These Terms and Conditions are governed by the laws of Victoria and entrants submit to the exclusive jurisdiction of the courts of Victoria and its courts of appeal.
     
  24. The prize will be provided to the prize winner by the Promoter and prize supplier. The prize winner is to liaise directly with:
