CLASS CLOWNS ARTWORK COMPETITION TERMS AND CONDITIONS

  1. The Class Clowns Artwork Competition (Competition) is conducted by Melbourne International Comedy Festival Limited ABN 43 006 697 918 of 240 Exhibition Street, Melbourne VIC 3000 (the Festival).

  2. The Festival is the Promoter of this Competition.

  3. Entry to the Competition constitutes acceptance of these Terms and Conditions.

  4. The Competition is open to all Australian secondary school students in Years 7-12 or 12-18 years old. The Festival reserves the right to request any entrant to provide documentary evidence confirming their age and to disqualify any entrant who is unable or unwilling to provide such proof of age upon request. Where a participating entrant is under the age of 18, the entrant’s adult parent/guardian must complete the entry by stating their own name on behalf of the name of the entrant to indicate their agreement with these Terms and Conditions on behalf of the entrant. Employees and their immediate families of the Festival and their agents are not eligible to enter the Competition.

  5. Entries must be received by 11:59pm AEST, Tuesday 7 September 2021.

  6. All entries are to be submitted via a completed online/electronic form, found on the Festival’s website . Incomplete or incomprehensible entries will be considered ineligible and will be discarded.

  7. Entries must provide complete and correct contact information: your name, name of parent/guardian (if applicable), mailing address, telephone and email. Incomplete or false information may cause your entry to be disqualified.

  8. The Festival accepts no responsibility for late, lost or misdirected entries. 

  9. All entries will be viewed and judged by the Melbourne International Comedy Festival.

  10. Entrants acknowledge and agree that their submission may be copied or reproduced for the purposes of judging the competition.

  11. All participating entrants acknowledge that:

  12. the artwork submitted is original work;

  13. the entrant owns the copyright to the artwork submitted and/or parts that comprise the artwork and are able to without impediment assign copyright in full to the Melbourne International Comedy Festival;

  14. the artwork is not licensed or otherwise encumbered in any way that may be inconsistent with these terms and conditions; and

  15. they have consent necessary to use any third-party intellectual property which has been substantially reproduced or incorporated into their artwork.

  16. All participating entrants indemnify the Festival against all claims, demands, losses and damages that the Festival incurs as a result of a breach of any warranties and agreement of obligations given by entrants under these Terms and Conditions.

  17. The competition decision is final and no correspondence will be entered into.

  18. A prize of $2,000 (AUD) will be payable to the winning entrant.

  19. The winning entry will be confirmed upon entrant signing of Agreement to License an Image.

  20. The winning entry will provide the Festival with the exclusive, non-transferable and non-assignable use of the artwork in perpetuity for the purpose of promotion of the Class Clowns Program and associated activities.

  21. The Festival may at its absolute discretion use part or the entire artwork for any purpose and in any form or manner.

  22. The Festival reserves the right to make alterations to the artwork and will reasonably endeavour to notify the entry/artist before altering the artwork

  23. The Festival will identify the winning entrant on the Class Clowns website.

  24. The Festival may amend these Terms and Conditions from time to time, and any amendments will be binding on all entrants.

  25. If, for any reason, the Competition is not able to be run as planned the Festival may cancel, terminate, modify or suspend the Competition without liability to any entrant, or any other person.

  26. The personal information you provide in connection with the Competition will be collected, stored and used in accordance with these Terms and Conditions and the Festival’s Privacy Policy, located at https://www.comedyfestival.com.au/legal#Privacy%20Policy. By entering the Competition all entrants agree to the use and disclosure of their personal information to third parties as specified in these Terms and Conditions and the Festival’s Privacy Policy. Where an entrant provides the personal information of any third party in connection with the Competition, the entrant warrants that the Promoter’s use of that personal information will not breach the Privacy Act or any other law.
